Not everyone may know these facts about expert witnesses when they are asked to consider hiring an expert to assist them on a family law case involving either income determinations or an equitable distribution of funds.
- Determining income for support purposes in family law cases can be extremely complicated without expert advice or assistance from an expert witness. Courts are looking for experts who can save time and go through various options on how income is determined to come up with numbers consistent with the law.
- A family law expert witness should be able to explain different types of compensation to a jury or judge, consider tax consequences, and be aware of IRS issues at play. The expert should be up-to-date on rules and changes that have occurred and be familiar with Long v. Long, 794 P.2d 1104 (Colo. App. 1988).
- Experts guarantee that work product will be deducted prior to calculating a person’s net income available for support. Many expenditure items after taxes can cost thousands. Our firm deducts retirement expenses from gross income prior to calculating disposable income. Some of these items include compliance with an individual retirement plan (IRP), compliance with a Simplified Employee Pension (SEP), penalty excise tax (5000) for being eligible for the IRA deduction, business record keeping involving paper shredders and filing fees, and professional corporation annual entity fees.
